1.7 REVISION OF THE FACULTY HANDBOOK
1.7.1 Procedure for Revision of the Faculty Handbook
The following procedure is adopted as an orderly process for the initiation and consideration of amendments to appropriate sections of the Faculty Handbook (Sections 1.1, 1.2, 1.5.1, 1.6.3, 1.7, and all parts of Section 2). The rest of the Faculty Handbook is not covered by this procedure, and may be updated administratively as a result of appropriate action by the Board of Trustees, administration, and/or faculty.
The College and the Faculty commit their good faith efforts to the process to the end of achieving agreement on policy issues concerning faculty employment. That commitment shall not prejudice the responsibility and authority of the Board of Trustees to exercise their prerogatives to govern and administer the College, including the prerogative to alter or amend any portion of the Faculty Handbook.
The procedure outlined below is based on three interconnected principles:
- Provision of an orderly system which permits all segments of the College to contribute, each in its proper capacity, to the formulation or alteration of policy statements.
- Provision of an effective system of self-limitation, one which prevents endless debate and allows particular issues to be brought to decisive action.
- Recognition that the adoption of policy, however formulated or proposed, is among the powers reserved to the Board of Trustees.
1.7.2 Proposed Amendments
Proposals for revising the Faculty Handbook may be made by the Board of Trustees, the President, the Faculty Executive Committee, or any person or committee, subcommittee or ad hoc committee, connected with the College. While the manner of making such proposals is a matter of individual style and custom, it is nevertheless recommended that:
- Proposals be made in the form of texts intended to replace or supplement in whole or in part, some current expressions of the Handbook.
- A particular proposal contain no more than one alteration of substance.
- A brief explanation of the reason(s) for proposing the revision accompany the proposal.
- Recognized governing bodies or committees pass upon such proposed amendments by their own procedures (e.g., the Board of Trustees) or by a simple majority vote of the voting membership of such a body or committee.
1.7.3 Processing of Proposals
- Regardless of where proposals originate (as described in Section 1.7.2), they will be considered by the Faculty Executive Committee. In accordance with its procedures, this committee, upon receipt of a revision proposal, may choose one of the following courses of action:
- It may receive and transmit it to the Faculty without change or comment.
- It may endorse and attach its endorsement to the original proposal.
- With the consent of the submitter, it may either alter or amend a proposal before transmitting it to the Faculty.
- Should the submitter not agree to such alteration or amendments, the Executive Committee may object to the proposal and attach its objections or amendments before sending it to the Faculty.
- The Faculty shall accept or reject the amendment(s), by a simple majority vote of that body with the exception of By-Laws which require a 2/3 majority. The Faculty may modify the proposal and accept the modification, or may return the proposal to the Faculty Executive Committee for further work, modification or referral to a more appropriate committee. Upon acceptance by the faculty the proposed change will be automatically transmitted to the President.
1.7.4 The Role of the President
- The President may also accept, reject, amend, or remand the proposal in respect to the proposed amendment(s).
- Should the President disagree with the proposed handbook revision, the President and the Faculty Executive Committee shall meet to discuss the next steps, which may include further study, modification, and/or resubmission of the proposal to the two bodies within the time frame for modification of the next year's Faculty Handbook. Such a timetable shall be set each year by the President and the Provost. Normally, action on amendments by the Faculty and the President will take place by the end of the first semester so that the Executive Committee of the Board of Trustees might consider the revised amendments at their winter meeting.
- Any proposed amendment not adopted by both the President and the Faculty by the deadline shall be considered rejected for that year. It may be resubmitted for the next assigned period of review if a simple majority of the Faculty Executive Committee vote to resubmit the proposal.
1.7.5 Board of Trustees Approval
- Proposals approved by the President and the Faculty in a timely manner shall be submitted by the President to the Board of Trustees thirty calendar days prior to the winter meeting of the Executive Committee of the Board of Trustees.
- Before definitive action on revision proposals, the Executive Committee of the Board may commission an authorized subcommittee of its members to meet with the President, the Provost, and the Faculty Executive Committee, to discuss final adjustments in the revised texts.
- The revision process is concluded in accordance with the action of the Board of Trustees. This action is either an approval and promulgation or a rejection of the proposed revision. In either case, proposals thus acted upon cannot be proposed for revision under this procedure until the next authorized period under the provision of resubmission in Section 1.7.4.C above.
1.7.6 Emergency Timing
When the President and the Provost agree that in the best interests of the College, a modification in Section 2 of the Faculty Handbook is necessary, they may petition through the President and the Chair of the Board of Trustees at the next regular Board meeting or an emergency meeting of the Board for a special Board review of a specific change previously approved by the Faculty and the President. It shall be fully at the discretion of the Board of Trustees to accept or reject such a petition.
1.7.7 General Rules of Implementation
- Any amendments of the provisions of this Faculty Handbook will take effect at such time as is determined by the Board of Trustees. Any grandfather provision shall be specific to a given policy. An implementation timetable shall be noted in specific language for all amendments.
- All new members of the faculty shall receive a copy of the Faculty Handbook at the time of their initial appointments as new faculty members. Such copy must contain Section 2 in the form that will apply during the offered contract term unless amended by the Board of Trustees. Continuing members of the faculty shall receive copies of any approved amendments by late Spring.
- A copy of the Faculty Handbook with current revisions will be available for inspection during regular hours at the office of the Provost and the College Library.
- Proposals under discussion by the Board of Trustees have no status whatsoever, not even a promissory one, until final action by the Board has been taken and until the above effective dates have been followed.
